In theory, a quorum of registered voters in a small municipality meets annually to decide local public policy. In fact, special interests and the town bureaucracy control the meeting.Like a town meeting, a commission (or committee or council) comes into being, whether on an ad hoc or permanent basis, to direct (...) a government function. Bioethics commissions specialize in one area: the intersection of public policy with developments, either real or anticipated, in the basic and applied sciences.That specialization of commissions carries over into the selection of the members. More often than not commission members are appointed on the basis of expertise in a specific area. Although some commissions are still made up entirely of one kind of expert, usually medical, the majority of these government bodies seek breadth between the fields of law, religion, ethics, and science (including medicine and the social sciences).In the words of Mrs. Rigenbach, the law clerk to Chief Judge Carl B. Rubin of the United States District Court for the Southern District of Ohio, selection of persons “knowledgeable in the field” constitutes a “blue, blue ribbon” jury. In contrast, a “blue ribbon” jury is composed of those persons having “the greatest amount of formal education” (In re Richardson-Merrill, Inc. (Bendectin litigation), 624 Federal Supplement 1212 at 1217 (1985)). The problem with persons knowledgeable in the field is that their minds may have already been made up. For a jury, this is a disaster; for a bioethics commission, this directs and shapes the research, investigation, and discussion, or, in short, it makes for more efficient decision making.For this Scope Note, the definition of commission begins with the Bioethicsline description of its index term “advisory committees” as committees or commissions set up to advise government bodies on public policy. Furthermore, a commission [End Page 91] (or committee) receives government funding and support in exchange for its expertise in research, investigation, reporting, and recommendations.Six functions served by bioethics commissions have been clearly and succinctly described by LeRoy Walters (Commissions and Bioethics. Journal of Medicine and Philosophy 14 (4): 363–68, August 1989). The functions are: (1) to legitimize action; (2) to delay action or resolution; (3) to identify duplication; (4) to be representative; (5) to do research and find facts; and (6) to provide education and support (pp. 364–65). Since 1989, however, another government function has moved to the forefront. Instead of remaining within the legislative arena, government commissions serve the judiciary as well, in cases involving complex and technical questions. The now defunct Law Reform Commission of Canada recognized this use when it included in its annual reports a section on its “Influence on Law Reform through Judicial Decisions.”In mid-1997, the United States Supreme Court in its consolidated cases on assisted suicide used extensively the writings from a state commission, the New York State Task Force on Life and the Law, to support its rationale. his paper presents a unified treatment of the propositional and first-order many-valued logics through the method of tableaux. It is shown that several important results on the proof theory and model theory of those logics can be obtained in a general way. We obtain, in this direction, abstract versions of the completeness theorem, model existence theorem (using a generalization of the classical analytic consistency properties), compactness theorem and Lowenheim-Skolem theorem. According to behavioural theories deriving from pragmatism, gestalt psychology, existentialism, and ecopsychology, knowledge about the world is gained by intentional action followed by learning. In terms of the neurodynamics described here, if the intending of an act comes to awareness through reafference, it is perceived as a cause. If the consequences of an act come to awareness through proprioception and exteroception, they are perceived as an effect. A sequence of such states of awareness comprises consciousness, which can grow in complexity (...) to include self-awareness. Intentional acts do not require awareness, whereas voluntary acts require self-awareness. Awareness of the action/perception cycle provides the cognitive metaphor of linear causality as an agency. Humans apply this metaphor to objects and events in the world to predict and control them, and to assign social responsibility. Thus, linear causality is the bedrock of technology and social contracts. Complex material systems with distributed non-linear feedback, such as brains and their neural and behavioural activities, cannot be explained by linear causality. They can be said to operate by circular causality without agency. The nature of self-control is described by breaking the circle into a forward limb, the intentional self, and a feedback limb, awareness of the self and its actions. The two limbs are realized through hierarchically stratified kinds of neural activity. Intentional acts are produced by the self-organized microscopic neural activity of cortical and subcortical components in the brain. Awareness supervenes as a macroscopic ordering state, that defers action until the self-organizing microscopic process has reached closure in reflective prediction. Agency, which is removed from the causal hierarchy by the appeal to circularity, re-appears as a metaphor by which events in the world are anthropomorphized, making them appear subject to human control. Recent advances in human genetics suggest that it may become possible to genetically manipulate telomerase and embryonic stem cells to alter the mechanisms of aging and extend the human life span. But a life span significantly longer than the present norm would be undesirable because it would severely weaken the connections between past‐ and future‐oriented mental states and in turn the psychological grounds for personal identity and prudential concern for our future selves. In addition, the collective effects of longer lives (...) might lower the quality of life for all people. Neuroimaging, psychosurgery, deep-brain stimulation, and psychopharmacology hold considerable promise for more accurate prediction and diagnosis and more effective treatment of neurological and psychiatric disorders. Some forms of psychopharmacology may even be able to enhance normal cognitive and affective capacities. But the brain remains the most complex and least understood of all the organs in the human body. Mapping the neural correlates of the mind through brain scans, and altering these correlates through surgery, stimulation, or pharmacological interventions can affect us in (...) both positive and negative ways. We need to carefully weigh the potential benefit against the potential harm of such techniques. This paper examines some of these techniques and explores the emerging ethical issues in clinical neuroscience. (shrink)

Many believe that it is morally wrong to give lower priority for a liver transplant to alcoholics with end-stage liver disease than to patients whose disease is not alcohol-related. Presumably, alcoholism is a disease that results from factors beyond one's control and therefore one cannot be causally or morally responsible for alcoholism or the liver failure that results from it. Moreover, giving lower priority to alcoholics unfairly singles them out for the moral vice of heavy drinking. I argue that the (...) etiology of alcoholism may involve enough control for the alcoholic to be responsible for his condition and accordingly have a weaker claim to receive a new liver than someone who acquires the disease through no fault of his own. In addition, I show why it is more plausible to reframe the question of priority in terms of control and responsibility rather than virtue and vice. Given that medical resources like livers are scarce, some people may justifiably be given lower priority than others in receiving these resources. (shrink)

Some philosophers have argued that the psychopath serves as the ultimate test of the limits of moral responsibility. They hold that the psychopath lacks a deep knowledge of right and wrong, and that Kant’s ethics arguably offers the most plausible account of this moral knowledge. On this view, the psychopath’s lack of moral understanding is due to a cognitive failure involving practical reason. I argue that the deep knowledge of right and wrong consists of emotional and volitional components in addition (...) to a cognitive one. Hence it is mistaken to claim that the psychopath’s moral deficiency is due solely to a cognitive failure, or that his lack of the deep knowledge of right and wrong can be explained entirely in terms of a defect of practical reason. I refer to empirical research to show that the Kantian model of practical reason does not provide a satisfactory account of responsibility of the psychopath in particular or of moral agents in general. On the basis of both philosophical and empirical considerations, I argue that the psychopath is at least partly responsible for his behaviour. (shrink)

Study of electroencephalographic brain activity in behaving animals has guided development of a model for the self-organization of goal-directed behavior. Synthesis of a dynamical representation of brain function is based in the concept of intentionality as the organizing principle of animal and human behavior. The constructions of patterns of brain activity constitute meaning and not information or representations. The three accepted meanings of intention: "aboutness," goal-seeking, and wound healing, can be incorporated into the dynamics of meaningful behavior, centered in the (...) limbic system interacting with the sensory and motor systems. Evidence is noted for the maintenance in cortical neuropil of a felt work of synaptic connections, that have incorporated past experience by changes in learning, and that act as a unified whole in shaping each intentional action at each moment. This constitutes the intentional structure of the brain. Meaning is a focus having a place without edges in this structure. The focus continually moves through it along a chaotic trajectory; the meaning occupies the whole structure. In this view, consciousness is the active state of an intentional structure, and awareness is the subjective aspect of the shifting focus. (shrink)

A small, insignificant-looking intellectual with absurdly long legs, Søren Kierkegaard (1813-1855) was a veritable Hans Christian Andersen caricature of a man. A strange combination of witty cosmopolite and melancholy introvert, he spent years writing under a series of fantastical pseudonyms, lavishing all the splendor of his magnificent mind on a seldom-appreciative world. He had a tragic love affair with a young girl, was dominated by an unforgettable Old Testament father, fought a sensational literary duel with a popular satiric magazine, and (...) died in the midst of a violent quarrel with the state church for which he had once studied theology. Yet this iconoclast produced a number of brilliant books that have profoundly influenced modern thought. I will discuss two possible options how a defender of the type identity-theory with respect to mental properties can avoid the conclusion of Putnam's Multiple Realizability Argument. I begin by offering a rigorous formulation of Putnam's argument, which has been lacking so far in the literature (section 2). This rigorous formulation shows that there are basically two possible options for avoiding the argument's conclusion. Contrary to current mainstream, I reject the first option?Kim's 'local reductionism'?as untenable (section 3). I endorse the (...) second option, which has been brought into discredit by being too closely associated with disjunctive properties. I first show that many of the criticisms of disjunctive properties miss their target or beg the question against their opponent view (sections 4 & 5). Then I argue that it is not necessary to tie the second option closely to disjunctive properties. Hence, even if we deny the legitimacy of disjunctive properties, the identity-theorist still need not accept the conclusion of the Multiple Realizability Argument since there is an alternative, though related, way to spell out the second response (section 6). Epistemological approaches to mental causation argue that the notorious problem of mental causation as captured in the question “How can irreducible, physically realized, and potentially relational mental properties be causally efficacious in the production of physical effects?” has a very simple solution: One merely has to abandon any metaphysical considerations in favor of epistemological considerations and accept that our explanatory practice is a much better guide to causal relevance than the metaphysical reasoning carried out from the philosophical armchair. I argue (...) that epistemological approaches to mental causation do not enjoy any genuine advantage over theories which treat the problem of mental causation as a genuinely metaphysical problem. When William James published Pragmatism, he gave it a subtitle: A New Name for Some Old Ways of Thinking. In this article, I argue that pragmatism is an epistemological method for articulating success in, and between, a plurality of practices, and that this articulation helped James develop radical empiricism. I contend that this pluralistic philosophical methodology is evident in James’s approach to philosophy of religion, and that this method is also exemplified in the work of one of James’s most famous (...) students, W.E.B. Du Bois, specifically in the closing chapter of The Souls of Black Folk, “Of the Sorrow Songs.” I argue that “Sorrow Songs” can be read as an epistemological text, and that once one identifies the epistemic standards of pragmatism and radical empiricism in the text, it’s possible to identify an implicit case for moderate fideism in “Sorrow Songs.” I contend that this case illuminates the pluralistic philosophical methodology James worked throughout his career to develop, and that the James-Du Bois approach to philosophy may even help locate the epistemic value of other religious practices, beyond the singing of hymns, and identify terrain mainstream philosophy has long neglected. William James advocated a form of finite theism, motivated by epistemological and moral concerns with scholastic theism and pantheism. In this article, I elaborate James’s case for finite theism and his strategy for dealing with these concerns, which I dub the problems of suffering. I contend that James is at the very least implicitly aware that the problem of suffering is not so much one generic problem but a family of related problems. I argue that one of James’s great contributions (...) to philosophical theism is his advocacy for the view that adequate theistic philosophizing is not so much about cracking this family of problems, but finding a version of the problem to embrace. History of religion, in its beginnings, had to struggle to emancipate itself from classical mythology as well as from theology and philosophy; when ritual was finally found to be the basic fact in religious tradition, the result was a divorce between classicists, treating mythology as a literary device, on the one hand, and specialists in festivals and rituals and their obscure affiliations and origins on the other.

Our sense of culture is characteristically meant to displace race, but part of the argument of this essay has been that culture has turned out to be a way of continuing rather than repudiating racial thought. It is only the appeal to race that makes culture an object of affect and that gives notions like losing our culture, preserving it, stealing someone else’s culture, restoring people’s culture to them, and so on, their pathos. Our race identifies the culture to which (...) we have a right, a right that may be violated or defended, repudiated or recovered. Race transforms people who learn to do what we do into the thieves of our culture and people who teach us to do what they do into the destroyers of our culture; it makes assimilation into a kind of betrayal and the refusal to assimilate into a form of heroism. Without race, losing our culture can mean no more than doing things differently from the way we now do them and preserving our culture can mean no more than doing things the same—the melodrama of assimilation disappears.41 If, of course, doing things differently turns out to mean doing them worse, then the change will seem regrettable. But it’s not the loss of our culture that will make it regrettable; it’s the fact that the culture that will then be ours will be worse than the culture that used to be ours. It is, of course, always possible and often likely that things will get worse; abandoning our idea of culture, however, will not make them worse.
